All generators, regardless of size, will be required to complete a hazardous waste emergency response plan, which will be reviewed by EPA and regional states to ensure that the plan adequately considers the potential for a large volume of mixed waste to be generated, including 10,000 gallons of mixed solid waste being generated each day.
The rulemaking also removes the existing rule that all generators were required to notify the region of the presence of suspected undiscovered mixed waste. The requirement that all generators take steps to detect mixed waste, however, has been retained and will be enforced by EPA.
